1. What you're agreeing to
By creating an account or using Clefwise, you agree to these terms. Clefwise is a web-based platform for managing music teaching businesses. If you don't agree to these terms, please don't use the service.
2. Accounts & roles
Clefwise has three account types:
- Teacher — creates a studio, manages students, scheduling, invoicing, and communication.
- Parent — invited by a teacher. Views schedule, lesson notes, invoices, and messages their teacher.
- Student — account created by a parent. Logs practice and views achievements.
You are responsible for maintaining the security of your login credentials. You must provide accurate information when creating your account. One person per account — no shared logins.
3. Teacher responsibilities
Teachers are independent businesses, not employees, contractors, or agents of Clefwise. Teachers are responsible for:
- The accuracy of student and parent data they enter into the platform.
- Their own privacy obligations to clients (including compliance with the Privacy Act if applicable to their business).
- Their billing and invoicing practices.
- Complying with applicable laws, including Working With Children checks and any relevant state regulations.
Clefwise does not verify teacher credentials, qualifications, or compliance status.
4. Acceptable use
You must not:
- Upload illegal, harmful, or offensive content.
- Use the platform to send spam or unsolicited communications.
- Attempt to access another studio's data or another user's account.
- Reverse-engineer, decompile, or attempt to extract the source code.
- Use Clefwise for any purpose other than music teaching business management.
- Interfere with the platform's operation or security.
- Create accounts using automated methods.
5. Payments & billing
Clefwise facilitates invoicing and payment collection between teachers and parents. Payments are processed by Stripe. Stripe's terms of service apply to all payment transactions.
Clefwise is not a party to the financial relationship between teachers and their clients. Teachers using Stripe Connect are responsible for their own Stripe account terms and obligations.
Clefwise subscription pricing (when applicable) is as displayed on clefwise.app at the time of purchase. All amounts are in Australian dollars (AUD) unless otherwise stated.
6. Intellectual property
Clefwise and its original content, features, and functionality are owned by Jackson Connor Pawelski trading as Clefwise.
Teachers retain ownership of all content they create or upload (lesson notes, files, student data). By using Clefwise, you grant us a limited licence to host, display, and transmit your content solely as necessary to provide the service. This licence terminates when you delete your account or remove the content.
7. Availability & warranties
Clefwise is provided on an “as is” and “as available” basis. We aim for high availability but do not guarantee uninterrupted or error-free service. We may perform maintenance that temporarily affects availability.
8. Limitation of liability
To the maximum extent permitted by law, Clefwise's total liability is limited to the fees you have paid to Clefwise in the 12 months preceding the claim, or AUD $100, whichever is greater.
Clefwise is not liable for any indirect, incidental, special, consequential, or punitive damages.
Nothing in these terms excludes or limits any rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded or limited by law.
9. Account termination
You may delete your account at any time through your account settings. For teachers, account deletion removes the studio and all associated data (students, lessons, invoices, messages).
We may suspend or terminate accounts that violate these terms, with notice where practicable. Provisions that by their nature should survive termination (limitation of liability, intellectual property, governing law) will survive.
10. Changes to these terms
We may update these terms from time to time. For material changes, we will notify you via email at least 30 days before the changes take effect. Continued use of Clefwise after the effective date constitutes acceptance.
If you disagree with changes, you may delete your account before they take effect.
11. Governing law
These terms are governed by the laws of South Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of South Australia. Nothing in these terms limits your rights under Australian Consumer Law.
